Who's Responsible - Owner or Operator?

Generally, port ownership fall under three (3) basic types, but remember that some environmental regulations impose duel owner/operator liability for environmental contamination so there is no clear cut answer:

  1. The operating port where the Port Authority develops and operates the majority of the activities. These ports have direct responsibilities for managing the aspects of the operations that might effect the environment.

  2. The landlord ports where the Port Authority provides the basic services/infrastructure and the tenants conduct the majority of the activities. As separate business entities, these tenants have the primary responsibility to keep activities within regulatory requirements.

  3. The combination ports where the Port Authority may operate some activities and tenants may operate other activities.
